Terms & Conditions
1. Definitions & Agreement Scope
1.1 ‘The Company’ refers to Velaris Property.
1.2 ‘The Client’ refers to the person or business commissioning the work.
1.3 These Terms govern all contracts for building services, renovations, HMO conversions, extensions, carpentry, flooring installation, bathroom and kitchen fitting, loft and garage conversions in Bournemouth, Poole & Christchurch.
2. Scope of Work & Variations
2.1 The scope – services, materials, timetables – will be detailed in a written Estimate or Quotation.
2.2 Any additional work not specified must be approved in writing and may result in price changes.
2.3 Unexpected issues (e.g. structural faults) discovered during work may incur additional charges.
3. Pricing & Payment
3.1 Estimates are valid for 30 days unless stated otherwise.
3.2 VAT is not included unless stated.
3.3 For larger projects, we may require a deposit or staged payments tied to milestones.
3.4 Final invoice is due on completion, or per agreed payment plan.
3.5 Late payments may attract interest at 8% per annum plus fixed recovery costs, per UK legislation.
4.1 Clients have a 14‑day cooling‑off period under the Consumer Contracts Regulations 2013, subject to service commencement rules.
4.2 Cancellation must be confirmed in writing.
4.3 Costs incurred up to cancellation date may still be payable.
5. Duration, Delay & Completion
5.1 Project timelines are estimates and subject to unforeseen circumstances.
5.2 Where work is delayed due to client failure or external factors, additional costs may apply.
5.3 Practical completion is achieved once work is accepted by the client and any retentions applied.
5.4 A retention (commonly 5–10%) may be withheld until defects are rectified.
6. Defects & Warranty
6.1 We offer a 12-month defect correction period post-completion for workmanship.
6.2 Clients must report issues in writing.
6.3 If defects are minor, a reasonable time will be given for correction.
7. Liability & Insurance
7.1 Our liability is limited to the contract value and does not include indirect losses.
7.2 We hold full Public Liability (minimum £5m), Employer’s Liability, and Professional Indemnity insurance.
7.3 Clients must carry suitable insurance during works.
8. Health & Safety / CDM Regulations
8.1 Both parties must comply with the Construction (Design and Management) Regulations 2015.
9. Rights & Intellectual Property
9.1 All design rights, plans, and IP created by Velaris Property remain our property until full payment.
9.2 Clients may not reproduce or share any element without written consent.
10. Sub-contractors & Assignments
10.1 We may engage sub-contractors of our choice but remain responsible for quality.
10.2 Clients may not assign or transfer contract rights without written approval.
11. Dispute Resolution & Governing Law
11.1 Disputes shall first attempt resolution via mediation.
11.2 Failing that, the law of England & Wales applies, with jurisdiction in local courts.
12. Force Majeure
12.1 Neither party is liable for delays caused by unforeseeable events beyond its control (e.g., extreme weather, supplier disruption).
13. Termination Rights
13.1 Clients and Velaris Property may terminate the agreement with written notice if serious breach or insolvency occurs.
13.2 Completed works up to termination shall be invoiced.
14. GDPR & Data Protection
14.1 Client data is processed securely and only used for service provision.
15. Use of Client Facilities, Utilities, and Access
15.1 Electricity and Water Usage
The Client agrees to provide access to reasonable amounts of mains electricity and water supply during the course of the project, at no charge, to enable us and our subcontractors to carry out the work efficiently and safely.
15.2 Use of Toilet Facilities
Where on-site toilet facilities are unavailable or restricted, the Client agrees to either permit access to a domestic toilet or allow the Company to arrange for portable toilet hire (which may incur an additional charge, to be discussed in advance).
15.3 Access and Parking
The Client shall ensure suitable access to the property is maintained for deliveries, equipment, and personnel. Any local parking permits or restrictions must be communicated in advance. If permits are required, costs may be added to the final invoice.
15.4 Security and Protection
While we take great care when working inside or around occupied homes, the Client is responsible for removing or protecting personal belongings, valuables, or delicate items from the working area prior to the commencement of works.
15.5 Pets and Safety
It is the Client’s responsibility to ensure pets or children are kept away from work areas to comply with health and safety regulations and to prevent potential injury or disruption.14.2 We comply with UK GDPR and the Data Protection Act 2018.
